Exploring informal components of clinical reasoning, we argue that they need to be understood via the analysis of professional wisdom. Wise decisions are needed where action or insight is vital, but neither everyday nor expert knowledge provides solutions. Wisdom combines experiential, intellectual, ethical, emotional and practical capacities; we contend that it is also more strongly social than is usually appreciated. But many accounts of reasoning specifically rule out such features as irrational. Seeking to illuminate how wisdom operates, we therefore build (...) on Aristotle’s work on informal reasoning. His account of rhetorical communication shows how non-formal components can play active parts in reasoning, retaining, or even enhancing its reasonableness. We extend this account, applying it to forms of healthcare-related reasoning which are characterised by the need for wise decision-making. We then go on to explore some of what clinical wise reasoning may mean, concluding with a case taken from psychotherapeutic practice. (shrink)

Sokal's intent was to parody the post modernist, relativist views of science that he felt were prevalent in Social Text and other like minded academic venues, and to see if by speaking the language of proponents of these views, he could get his parody published as a serious academic paper. In short, "Transgressing the Boundaries: Toward (...) a Transformative Hermeneutics of Quantum Gravity" was a hoax. Backround Education in ethics and professionalism should reflect the realities medical students encounter in the hospital and clinic. Method We performed content analyses on Case Observation and Assessments (COAs) written by third-year medical students about ethical and professional issues encountered during their internal medicine and paediatrics clinical clerkships. Results A cohort of 141 third-year medical students wrote 272 COAs. Content analyses identified 35 subcategories of ethical and professional issues within 7 major domains: decisions regarding treatment (31.4%), communication (21.4%), professional duties (...) (18.4%), justice (9.8%), student-specific issues (5.4%), quality of care (3.8%), and miscellaneous (9.8%). Conclusions Students encountered a wide variety of ethical and professional issues that can be used to guide pre-clinical and clinical education. Comparison of our findings with results from similar studies suggests that the wording of an assignment (specifying “ethical” issues, “professional” issues, or both) may influence the kinds of issues students identify in their experience-based clinical narratives. Reasoning and judgement in health care entail complex responses to problems whose demands typically derive from several areas of specialism at once. We argue that current evidence- or value-based models of health care reasoning, despite their virtues, are insufficient to account for responses to such problems exhaustively. At the same time, we offer reasons for contending that health professionals in fact engage in forms of reasoning of a kind described for millennia under the concept of wisdom. Wisdom traditions refer to (...) forms of deliberation which combine knowledge, reflection and life experience with social, emotional and ethical capacities. Wisdom is key in dealing with problems which are vital to human affairs but lack prescribed solutions. Uncertainty and fluidity must be tolerated in seeking to resolve them. We illustrate the application of wisdom using cases in psychiatry, where non-technical aspects of problems are often prominent and require more systematic analysis than conventional approaches offer, but we argue that our thesis applies throughout the health care field. We argue for the relevance of a threefold model of reasoning to modern health care situations in which multifaceted teamwork and complex settings demand wise judgement. A model based on practical wisdom highlights a triadic process with features activating capacities of the self, other and aspects of the problem itself. Such a framework could be used to develop current approaches to health care based on case review and experiential learning. (shrink)

The book begins with a masterful reconstruction of the tradition of American philosophy from Emerson and Thoreau to Peirce and James and Dewey, culminating in Rorty. This beginning, from the Preface entitled “Rorty’s ‘Violence of Direction’” to Chapter 1 entitled “From Pragmatism to Rortyism” occupies almost the first third, and seems to establish a three-part structure, of the book. _Shusterman’s Somaesthetics_ is a wide-ranging collection of penetrating essays by twelve scholars examining in rich detail the many dimensions of philosopher Richard Shusterman’s pragmatism and somaesthetics, complemented by his own chapter of responses to these scholars.

Featuring essays by some of the most prominent names in contemporary political and cultural theory, _Sovereignty in Ruins_ presents a form of critique grounded in the conviction that political thought is itself an agent of crisis. Aiming to develop a political vocabulary capable of critiquing and transforming contemporary political frameworks, the contributors advance a politics of crisis that collapses the false dichotomies between sovereignty and governmentality and between critique and crisis. This rich and varied collection of essays addresses some of the most fundamental human questions through the lenses of philosophy, literature, religion, politics, and theology. Peter Augustine Lawler and Dale McConkey have fashioned an interdisciplinary consideration of such perennial and enduring issues as the relationship between nature and history, nature and grace, reason and revelation, classical philosophy and Christianity, modernity and postmodernity, repentance and self-limitation, and philosophy and politics.

Michel Foucault's early works criticize the development of modern democratic institutions as creating a surveillance society, which functions to control bodies by making them feel watched and monitored full time. His later works attempt to recover private space by exploring subversive techniques of the body and language. Following Foucault, pragmatists like Richard Shusterman and Richard Rorty have also developed very rich approaches to this project, extending it deeper into the literary and somatic dimensions of self-stylizing. Yet, for a debate centered (...) on the re-creation of the vision of the self, these discussions have yet to fully engage—even while they set the conditions for this engagement with—issues of posthuman technologies, such as AI, robotics, and genetic engineering. These certainly will constitute the primary engine of public institutional surveillance in the years to come. With this surveillance, the two spheres of private self-fashioning and public institutions will continue to evolve in relation to one another. As they do so, democratic society will change considerably. Perhaps Rorty's own normative and linguistic ideal of conversational maintenance may provide something of a democratic limit case on any future posthuman self-fashioning. (shrink)

The traditional basis for advocating ethical business conduct has been morality defined in philosophical or religious terms. However, fairness and moral obligation have provided little incentive for anything like universal ethical business behavior.The idea that "good ethics is good business" as an incentive is looked upon with skepticism by those with bottom line responsibility. However, if managers were aware of the extent to which certain business behaviors impose significant costs on individual transactions and relationships, a valid incentive would exist.

Citizens have two mutually exclusive options: they can exile, or even execute, a god among men, or they can submit to superhuman monarchy. Aristotle thinks any state would choose the former, but finds the latter option superior and argues the citizenry should submit to the superhuman monarch because that is precisely what ideal citizens would do if such a being appeared in their society. This problem appears in great cinema and nowhere more powerfully than in J. J. Abrams's Star Trek (...) and Star Trek Into Darkness with the character of James T. Kirk. In his Nicomachean Ethics, Aristotle describes a man he calls the megalopsychos, the great‐souled man or proud man. Aristotle defines the two solutions to the problem of greatness, exile or monarchic rule, as mutually exclusive, but Kirk is able to progress from exile on Delta Vega to the captain's chair, the former seeming necessary for the latter. While databases of taboo language word norms exist, none focus specifically on slurs as a category of taboo language. Furthermore, no existing databases include measures of linguistic reclamation, a phenomenon which may specifically affect the processing of slurs. I produced a database in which 155 native or near-native speakers of British English rated 41 LGBTQ+ slurs for a number of word properties and measures of linguistic reclamation. I then ran correlation and demographic group comparison analyses on the resulting database. I (...) found a clear correlation pattern between properties and reclamation behaviours. I also found that there were age-related differences in age of acquisition and familiarity ratings; that gender identity and sexual identity differences were affected by being the target of slurs; and that sexual identity particularly affected differences in reclamation ratings. From Voltaire's correspondence with Catherine the Great, to AdamSmith's travels on the European continent, mediated and unmediatedcommunication networks were the lifeline of the Enlightenment. Although some older historical studies highlightthe importance of social networks in the Enlightenment, data-driven approachesallow for a more comprehensive and granular understanding of the many differenttypes of networks that formed the intellectual and cultural infrastructure ofthe Enlightenment throughout Europe. ‘Tool of Empowerment’: The Rhetorical Vision of Title Nine This study of the mail order catalog Title Nine, a California-based women's athletic clothing company, employs symbolic convergence theory and fantasy theme analysis through the context of third wave feminism. The catalog, named after the federal law in the United States that was intended to equalize opportunities between men's and women's participation in sports, creates a distinct social reality in an effort to empower readers. Similar studies have analyzed stereotypical representations of (...) women in magazines and advertising. However, this study offers insight into a newly emerging phenomenon in a niche market, the mail-order catalog, and in the artifact under study, it offers a medium where creators intend to do more than sell women's clothing. Within fantasy theme analysis is the fantasy type, a moral or social more that repeats itself through various actors or settings within the artifact. Four fantasy types put forth by Title Nine have been identified by the researcher, including a.) "I am superwoman," b.) "I am a mom," c.) "I am an advocate for women," and d.) "I can be anything.". This study of philanthropy among large Black-owned businesses provides insights into a sector of business giving which has not been studied. Results indicate that philanthropy and ethical justifications play a more important role in minority business enterprises than in non-minority firms studied previously.

Objective Moral distress is a complex phenomenon experienced by healthcare professionals. This study examined the relationships between key dimensions of Organizational Culture in Healthcare (OCHC)—perceived psychological safety, ethical climate, patient safety—and healthcare professionals’ perception of moral distress.Design Cross-sectional surveySetting Pediatric and adult critical care medicine, and adult hospital medicine healthcare professionals in the United States.Participants Physicians (n = 260), nurses (n = 256), and advanced practice providers (n = 110) participated in the study.Main outcome measures Three dimensions of OCHC were (...) measured using validated questionnaires: Olson’s Hospital Ethical Climate Survey, Agency for Healthcare Research and Quality’s Patient Safety Culture Survey, and Edmondson’s Team Psychological Safety Survey. The perception of moral distress was measured using the Moral Distress Amidst a Pandemic Survey. The hypothesized relationships between various dimensions were tested with structural equation modeling (SEM).Results Adequate model fit was achieved in the SEM: a root-mean-square error of approximation =0.072 (90% CI 0.069 to 0.075), standardized root mean square residual = 0.056, and comparative fit index =0.926. Perceived psychological safety (β= −0.357, p <.001) and patient safety culture (β = −0.428, p<.001) were negatively related to moral distress experience. There was no significant association between ethical climate and moral distress (β = 0.106, p = 0.319). Ethical Climate, however, was highly correlated with Patient Safety Culture (factor correlation= 0.82).Conclusions We used structural equation model to test a theoretical model of multi-dimensional organizational culture and healthcare climate (OCHC) and moral distress.Significant associations were found, supporting mitigating strategies to optimize psychological safety and patient safety culture to address moral distress among healthcare professionals. Future initiatives and studies should account for key dimensions of OCHC with multi-pronged targets to preserve the moral well-being of individuals, teams, and organizations. (shrink)

In 2001, three non-Aboriginal men in their twenties were charged with the sexual assault of a twelve year old Aboriginal girl in rural Saskatchewan. Legal proceedings lasted almost seven years and included two preliminary hearings, two jury trials, two retrials with juries, and appeals to the provincial appeal court and the Supreme Court of Canada. One accused was convicted. The case raises questions about the administration of justice in sexual assault cases in Saskatchewan. Based on observation and analysis of the (...) record, this paper: (1) examines relationships between legal errors dealing with availability of the defence of “belief in consent” and interpretation of the “all reasonable steps” provision, the need for retrials, and apprehended race-gender-age bias and discrimination; and 2) proposes incremental and systemic remedies to address the weaknesses in police, prosecutorial and judicial policy and practice highlighted by this case. Within the Pragma-Dialectical School of argumentation theory both a normative and a descriptive component are essential in order to account for a reconstruction of argumentative language use. This paper concentrates on the descriptive component and discusses the choice of the adjacency pair as a tool for the systematic description of the confrontation stage of argumentative conversations. First a structural description of confrontation in conversation is developed from the discourse analytical approach to argumentation of Jackson and Jacobs, within the normative frame (...) of the theory of argumentation of Van Eemeren and Grootendorst. Then the pro's and con's of the adjacency pair model for the analysis of conversation in general and for that of argumentative conversation in particular are discussed. Where the adjacency pair fails, alternative models like Edmondson's model for the analysis of spoken discourse (1981) are examined. Finally the description of confrontation in conversations in terms of the adjacency pair is shown to be in line with the rational model for describing the pragmatic aspects of conversational coherence proposed by Jackson and Jacobs in 1983 and with their current thinking on the status of adjacency pairs (1987). For the elaboration of Jackson and Jacobs' sketch of a rational model of conversational coherence the use of notions from Edmondson's model of interactional analysis is recommended. (shrink)

This article examines the distinction between judicial reasoning flawed by errors on questions of law, properly addressed on appeal, and errors that constitute judicial misconduct and are grounds for removal from the bench. Examples analysed are from the transcripts and reasons for decision in R v George SKQB (2015), appealed to the Saskatchewan Court of Appeal (2016) and the Supreme Court of Canada (2017), and from the sentencing decision rendered by the same judge more than a decade earlier in R (...) v Edmondson SKQB (2003). Both were sexual assault cases. In George a thirty-five year old woman with five children was tried and ultimately acquitted of sexual assault and sexual interference after she was assaulted in her home by a fourteen year old male. Striking similarities between the reasoning and language in the trial decision in George and the sentencing decision in Edmondson demonstrate entrenched antipathy for sexual assault law and the fundamental principles of justice, equality, and impartiality. This is arguably judicial misconduct, persisting despite access in the interim to many years of judicial education programming, not merely legal error. The problem does not lie with the judge alone, however. A toxic mix of misogyny and blindly zealous enforcement of the law appears to have undermined the administration of justice in George from the outset at all levels. The problems are systemic. Were this not the case, it is likely that Barbara George would not have been charged. (shrink)

Resources for Feminist Research, Vol. 3, No. 4, pp. 44-45, 1985 In this brief article, written in 1984 and published the following year, Lucinda Vandervort sets out a comprehensive agenda for enforcement of sexual assault laws in Canada. Those familiar with her subsequent writing are aware that the legal implications of the distinction between the “social” and “legal” definitions of sexual assault, identified here as crucial for interpretation and implementation of the law of sexual assault, are analyzed at length in (...) “Mistake of Law and Sexual Assault: Consent and Mens Rea” (1986), published at (1987-88) 2(2) Canadian Journal of Women and the Law, 233 309. In that article the author argued that most mistakes about consent are not mistakes about a “fact” that may sometimes negative mens rea, but are actually mistakes about the law that afford accused no excuse under either Canadian common law or statutory criminal law. She argued further that consent must be interpreted as “voluntary agreement” and must be affirmatively and unequivocally communicated in order to operate as an effective waiver of a person’s legal right to be free from interference with his or her bodily integrity. That article was a central reference point in the consultations leading to the 1992 amendments to the sexual assault provisions in the Canadian Criminal Code and in some key decisions by the Supreme Court of Canada in sexual assault cases in the 1990’s. As a result of a gradual transformation of theoretical analysis of the law of mens rea and consent in Canada, culpable awareness is now understood by many jurists and criminal law theorists quite differently than it was twenty-five years ago. As Vandervort acknowledged in her 1984 Agenda for Action, however, clarity in legal theory and legal doctrine is no guarantee of how sexual assault laws will operate in practice. Theory and practice, doctrine and its implementation, often diverge. This phenomenon is still seen in some decisions taken at the trial, pre-trial, and pre-charge stages in sexual assault cases. Police, prosecutors, and many trial judges, like accused, may often be influenced by traditional attitudes about sexual consent and mistaken about the law of consent. Accordingly, in her recent work Vandervort re-visits and re-examines the exercise of discretion by police, prosecutors, and the judiciary. An example is her 2009 article “Legal Subversion of the Criminal Justice Process? Judicial, Prosecutorial and Police Discretion in R. v. Edmondson, Kindrat and Brown” in Sexual Assault Law, Practice & Activism in a Post-Jane Doe Era, edited by Elizabeth Sheehy (Ottawa: University of Ottawa Press, 2012). In this and some of her other recent work, the distinctions between social and legal norms and questions of fact and law, previously analyzed with the objective of clarifying the law, are used to control the effects of social ignorance and partiality in the handling of sexual assault complaints by decision-makers in the criminal justice system at trial and pre-trial. Lucinda Vandervort’s published and unpublished legal and philosophical writings on sexual assault and sexual assault law illustrate the development of a socio-legal scholar’s “Agenda for Action” into a principled, pragmatic, open-ended exercise in “institutional design.” Across two centuries, from the revolutionary era of the 18th century to the present, other radical egalitarians would recognize both the impetus for the project and many features of the political and cultural resistance to it. Previously scorned as tendentious time-server and panderer to the powerful, he has received increasingly serious attention in recent years. Indeed, a veritable Josephus industry has emerged, with regular (...) international colloquia, a burgeoning number of publications, and major commentaries on individual works (and parts of works) in the course of publication though collaborative projects in both German and English. And properly so. Josephus for too long remained the province primarily of scholars in Jewish studies. Classicists, for the most part, marginalized or ignored him. That neglect seems quite myopic in view of the unusually large corpus and the importance of Josephus not only for Jewish history but also for classical literature and historiography, for the perceptions of imperial power by subordinate peoples, and for the place of "alien wisdom" in the intellectual and cultural world of the Roman empire. The shift toward fuller and closer scrutiny of Josephus' work by classical scholars is now well underway—and most welcome.The essays in this volume laudably promote that enterprise. They grow out of a stimulating conference held at York University in Toronto in 2001. The editors deserve credit for focusing on a critical but largely overlooked subject: the relationship of Josephus' work to the social, political, and cultural setting in which he wrote, namely that of Rome in the Flavian era. Unlike most conference volumes, the quality of the papers is uniformly high, and the collection as a whole unusually coherent. The volume is a model example of its genre.The Jewish war culminated in the destruction of the Temple in Jerusalem in 70 c.e. The consequences for Jewish history, of course, were momentous, a familiar and frequently explored topic. Much less studied but indispensable for an understanding of Josephus' work are the reverberations in Rome. The Flavian emperors exploited their victory to publicize, justify, and entrench a new imperial dynasty. Fergus Millar valuably surveys the monuments of Rome instituted to commemorate the conquest of Judaea: the arches erected for Titus, the Colosseum built with the spoils of the Jewish war (as Alföldy stunningly demonstrated a few years ago), and the Temple of Peace where the most celebrated objects [End Page 615] captured in Jerusalem were deposited. The Flavian public-relations spin not only celebrated military prowess but also made a pointed contrast with the age of Nero and underscored the arrival of a pax Flaviana. Advertisement of triumph over Judaea could hardly make the Jews of Rome comfortable, as Martin Goodman argues. He adds that imposition of the fiscus Iudaicus under Vespasian and malicious accusations under Domitian against those who lived like Jews but did not acknowledge their Judaism must have produced an oppressive atmosphere in the Flavian years. James Rives goes beyond this, arguing that the destruction of the Temple and the depositing of sacred objects represented a genuine effort to stamp out the Temple cult which, in Roman eyes, constituted a civic cult and a threat to imperial stability. Daniel Schwartz's paper, with different objectives, extends this theme still further. He points to the ostensibly anomalous decision to resume the administration of the Jewish state as a Roman province instead of bestowing it upon the Roman supporter Agrippa II as an enlarged kingdom. For Schwartz, this amounted to a decision to eliminate Judaea as a territorial entity, a decision reflected in the fact that the term Ioudaioi tended to lose its geographical connotation thereafter and became a designation for "Jews" rather than "Judaeans." The scene after 70, in short, was grim indeed. One might question some of the more speculative ideas expressed in these essays, such as Goodman's suggestion that "Judaizing" indicated opposition to the Flavian regime or Rives' notion that Rome regarded Jerusalem as a rival focus of loyalty in the empire. Some philosophers of fiction – most famously Jerold Levinson1 - have tried to argue that fictional narrators can never be identified with real authors. This argument relies on the claim that narration involves genuine assertion (not just the pretense of assertion that lacks truthfulness) and that real authors are not in a position to assert anything about beings on the fictional plain - given that they don’t rationally believe in their existence. This debate on the status of narrators depends (...) on the idea that fictional beings and beings in the real worlds reside, as it were, at different levels. The assumption that there is a gap separating the levels of fiction and reality serves as a rationale for the claim that real authors could not possibly be en rapport with the fictional characters that they create (e.g. entertain beliefs about them, etc.).
